Any content, data or information stored on or uploaded to this service whether by you or a third party using your password is your responsibility. You must comply at all times with all relevant laws and regulations relating to such activities or information. This includes but is not necessarily limited to: copyright; defamation; trademarks; data protection or any regulation of offensive, obscene or illegal content. We reserve the right to access any content, data or information stored on this service or email messages sent via this service and remove all or any part of such information or message if we deem it to be actually or potentially inappropriate or illegal. However, The Zumiga Ltd. is under no obligation to monitor any such information, content or messages and it is your responsibility to comply with any applicable law, regulation and these terms. You will indemnify us against any loss we may incur as a result of your breach or any alleged breach of any such law or regulation by any third party.

Registration and membership

The Zumiga Ltd. reserves the right to terminate immediately and remove completely from the system any member who we believe to be:

• using any service illegally
• attempting to abuse or misuse any service in any manner
• attempting to gain unlawful or inappropriate entry into any section of any service or disrupt the normal functioning of any service in any manner
• attempting to abuse any service in any way outlined in this document through the unsanctioned use of the username and password of another individual
• attempting to, what is commonly known as, ‘hack' any part of any service in any manner

You will indemnify us against any loss we may incur arising out of such misuse as outlined above and we have no prior need to give you any warning or any reason if we believe you are at fault.

Registration applies to the individual or business and is non-transferable. If we feel it is appropriate to do so, we reserve the right to:

• remove or suspend the registration
• remove or suspend the login
• alter or remove any details stored by our systems against your account
• track the actions of any registered member within the service

Your password may only be used by you and it is your responsibility to keep it confidential. You will be held responsible for all use of any service using your password. You may change your password at any time through the settings page within your account. You will indemnify us against any loss we may incur arising out of the unauthorised use of your password.

Placing an order

By placing an order with Zumiga Ltd. you confirm that you are in agreement with and bound by the terms and conditions below:

1.Zumiga Ltd will carry out work on website or logo design only when a prepayment of 50% of order value will be paid by user.

2.Websites created by us can be fully hosted on our server. In such case Zumiga Ltd cannot accept liability for losses caused by the unavailability, malfunction or interruption of either service, or for loss of turnover, sales, revenue, profits or indirect, consequential or special loss.

3.Should you choose to host your website on your own hosting service it is your responsibility to run the website on your server. You will be provided with the necessary files and a copy od MySql database.

4.Once your site is live on your domain it is assumed that the project has been completed to your satisfaction. Any additional work is then charged at the prevailing support cost.

5.Should you choose the package Pro or Business which allows you to make changes to your own site and amend content, Zumiga Ltd. does not accept responsibility for any changes that you make to your site.

6.All text and images submitted must be free of copyright. Zumiga Ltd accepts no responsibility for any infringement of copyright law arising from any text or images used on your site. Text needs to be sent in a format that allows us to copy and paste, keeping the existing formatting in place.

7.We may include plugins on your website to improve the overall user experience on your site. These include but are not limited to contact forms, image slideshows, videos and maps. As these are third party apps hosted by another supplier we cannot accept responsibility for any loss of service or malfunction that may occur. Each third party reserves the right to alter or remove their service and or charge fees if certain usage limits are reached. Customers will be notified in such event and would be able to decide whether or not to continue with the service or to find an alternative provider.

8.We reserve the right to include a screenshot of, and link to your completed website on the portfolio page of our website, review websites, and on any of our social media accounts.

9.Your hosting period begins once your site is live on your domain, or once your domain has been registered (whichever comes first). If you do not make your payments on time the hosting will expire and your site will no longer be live. Once hosting has expired, it will be possible to reinstate your website for a period of 7 days, after 7 days your site will be permanently deleted. Zumiga Ltd excludes liability for any loss of profit caused to the customer by the expiration of the hosting as a result of the customer’s failure to renew their services.

10.All domain names registered by us will be registered in the customer name and as such the domain name belongs to the client, not to Zumiga Ltd. The domain will be registered for 1 year. The customer is responsible for its renewal. If the customer does not renew it the domain will expire and will be available for general sale. No cash alternative is available for customers who purchase their own domain name. The customer may require Zumiga Ltd for domain extension assistance at least 2 weeks before its expiration date.

11.Zumiga Ltd excludes liability for any loss of profit caused to the customer by the expiration of the domain name as a result of a technical fault or any other fault caused by the hosting company or any third party.

12.All sites hosted on our servers are limited to a total of 5GB of data storage. Should you use more than 5GB of storage we will request for you to either pay an additional hosting fee of £10 per month per GB.

13.If the final payment has not been received within 6 months of the original order being placed Zumiga Ltd reserve the right to cancel this agreement without notice. All design work carried out will be permanently deleted from our hosting platform and no refund will be payable. Any domains or email accounts that may have been registered will also be cancelled and no refund will be payable.

14.Due to external factors we cannot offer any guarantees regarding the search engine position we will achieve for websites. We cannot accept liability for any change in rankings, or drop off in the position of your website due to changes in the algorithms of the search engines or the factors that they use to rank websites.

15.Red Website Design Ltd reserve the right to refuse to handle in any way, material which may be deemed offensive, illegal or controversial. We also reserve the right to refuse to handle any site found to be involved in any black hat search engine optimisation techniques. Should any of these situations arise we reserve the right to terminate your web hosting service without notice and you would not be due a refund.

Charges and payments

1.All prices listed on the ZumiDesign.com website are exclusive of VAT. Depending on whether the customer is a natural person or a company and in which country the customer's company is registered, VAT may be added to the price of the service.

2.The Charges shall be calculated in accordance with the ZumiDesign.com pricing plans, as set out in the price list on the Website and confirmed in the Order.

3.Zumiga Ltd reserves the right to increase its pricing plans as set out on the Website. All quotes with previous pricing plans will be valid within 14 days since the date of such quote.

4.The invoice will be issued by Zumiga Ltd. after payment of the entire order.

5.Payment can be made via PayPal or credit card. Credit card payments are processed by Przelewy24 in cooperation with Evalon Inc. 6.Payment for the website and logos design is divided into two parts. The first one is a prepayment of 50% of the order value and it is required before starting work on your project. The final payment (the remaining 50% of the order value) must be paid after the completion of the project, not later than 7 days after its completion. Other payments (e.g. for hosting, additional work on your project) are not divided and are required within 7 days from the date of order.

Money back guarantee

Zumiga Ltd. offers a satisfaction guarantee for the website and logo design. If you are not satisfied with our design, we will refund the money you paid. Money back guarantee applies to the website or logo mockup we have prepared. If you accept the mockup design of homepage of your website or logo project and we proceed to further work on your project, you cannot request a refund and you will have to pay for the entire order. The refund will be processed through the same payment channel as you paid order (e.g. if the order was paid by credit card then the refund will be made to the same credit card).

Complains

Complaints should be sent to: info@zumidesign.com. All complaints will be considered within 14 days. A response to the complaint will be given by e-mail to the e-mail address from which the complaint was sent.

Termination of the agreement

Due to the nature of the service provided by Zumiga Ltd., the customer cannot terminate the agreement if he has accepted the mock-up of the website or logo design.
